Q: How can I find a good defense attorney?

A: Recommendations for finding a good defense attorney:

  • Someone who only practices criminal law &
  • Has experience.
  • Word of mouth. Talk to your friends
  • Beware of bargains (similar to a surgeon, this isn’t an area where you should be cutting corners) Get the best person you can reasonably afford.

An attorney who is being honest with you may not have all the answers right away. Be wary of attorneys who make promises or absolutes without knowing about your case.

Q: What questions should I ask a prospective attorney?

A: Questions you should ask your attorney include:

  • What is their experience?
  • What is their opinion?
  • What are their fees & how are they assessed?
  • See & review a retainer agreement
  • What the attorney can & cannot do for you

Q: What should I bring with me when I first go to see an attorney?

A: When you go to an attorney for a case evaluation you should bring:

  • All paperwork or documents that you have regarding your case
  • Personal identifying information
  • If you have evidence, you should at least bring a list
  • List of questions for your attorney

Q: Are public defenders as qualified as other attorneys?

A: Each attorney is different. Most public defenders are very qualified and are very good attorneys but can be overworked and sometimes burned out. Some of the best attorneys I know are public defenders.

Q: What if I’m arrested and need an attorney right away?

A: Once you ask to speak to an attorney, the police can legally no longer question you. Unlike TV, they don’t need to rush an attorney in to see you in the middle of the night.

When you are charged for any court proceedings you are entitled to have an attorney present. If you’d like an attorney during questioning you may have to hire one independently.

Q: Are there alternatives to private council and public defenders?

A: Yes, you can represent yourself, however that is always unwise.
